
Sam Augustus Layne Jailed for Seven Years for Banbury Rape
RAPIST WHO ATTACKED SLEEPING VICTIM JAILED FOR 7 YEARS
A 41-year-old man who raped a woman while she slept fully clothed following a night out in Banbury has been sentenced to seven years’ imprisonment.
Sam Augustus Layne, formerly of Albert Street, Banbury, and latterly of Gleneagle Road, Lambeth, London, was sentenced at Oxford Crown Court on Wednesday, June 10, 2026. He had previously been found guilty by a majority jury verdict of one count of rape of an adult female, following a four-day trial that concluded on April 30, 2026. He had been remanded in custody since the conviction.
The court heard details of the incident, which occurred in the early hours of February 15, 2023. On Valentine’s Day (February 14), Layne and the victim—a woman aged in her twenties at the time—had been socialising in Banbury, playing darts at the Dog and Gun public house before moving to the Horse and Jockey to play pool.
Following the evening out, Layne, who was known to the victim, invited her back to his flat on Albert Street to continue socialising.
The victim eventually fell asleep at the property, fully clothed. The court heard that when she woke up, she realised Layne had proceeded to rape her while she was asleep, vulnerable, and entirely unable to consent. She immediately accused him of the assault.

The attack was initially reported to Northamptonshire Police by a friend of the victim at approximately 19:20 on February 17, 2023. A thorough investigation by Thames Valley Police followed, leading to Layne's arrest the following day on February 18, 2023. He was subsequently formally charged more than a year later on April 26, 2024.
During the proceedings, the court was informed of Layne’s extensive criminal record. He holds 22 previous convictions encompassing 41 separate offences. The prosecution noted that none of his previous convictions were of a sexual nature, with the majority relating to drug offences. Layne had also separately pleaded guilty to possession of a Class B drug, namely cannabis, at Oxford Crown Court in July 2025.
In handing down the seven-year custodial sentence, Judge Hassan Khan outlined the severe psychological and emotional toll the attack took on the victim.
Addressing Layne in the dock, Judge Khan stated: "She gave no impression that any sexual activity would be happening. She was shocked and distressed about what was happening. She clearly experienced ongoing distress."

The judge continued: "It was a huge violation of her dignity. She was asleep and unable to consent. You are a high risk of serious harm to females."
Alongside the seven-year prison term, Layne was made the subject of a Sexual Harm Prevention Order (SHPO) for 15 years and an indefinite restraining order forbidding him from contacting the victim. He is also subject to indefinite notification requirements on the Sex Offenders Register.
Speaking after the sentencing, the investigating officer, Detective Constable Sarah Osborne of the North Oxfordshire Criminal Investigation Department, praised the victim's resilience.
"I commend the victim for her bravery in coming forward and for her strength throughout the criminal justice process," DC Osborne said. "Reporting such an offence can be incredibly difficult, and her courage should not be underestimated."

She added: "The victim fell asleep fully clothed in the presence of a man she trusted to keep her safe. Sam Layne chose to exploit that trust, raping her while she was asleep, vulnerable, and unable to give consent. This was a serious and profound violation of her trust, her dignity, and her sense of safety."
DC Osborne concluded by emphasising the force's commitment to tackling violence against women: "I am pleased that Sam Layne has now been held accountable for his actions. This conviction reflects the seriousness of the offence and the harm caused.
I hope this outcome sends a clear message that offences of this nature will be thoroughly investigated and pursued. Thames Valley Police remains committed to supporting victims and tackling violence against women and girls."
